みなさん、こんにちは。当事務所の所長を務めております、司法書士の小口一成(おぐちかずなり)と申します。
Hello, everyone ! I am a chief Shiho-Shoshi lawyer of this office, Kazunari Oguchi.
私は、平成7年5月に司法書士登録後、出生の地である長野県 岡谷市を拠点として、司法書士事務所を開業してきました。
I had worked as a Shiho-Shoshi lawyer since May 1995 in Okaya City, Nagano Prefecture, where I was born.
破産・個人再生・特定調停・任意整理への取り組み
devoting to bancruptcy, civil rehabilitation, specific arbitration and debt arrangement
この間、当事務所では、通常の司法書士業務のうち、とりわけ、自己破産や個人民事再生(個人再生)、特定調停などの申立書の作成、すなわち「書類作成業務」を通じて、多重債務に苦しんでいる方々の支援に力を注いでまいりました。
Since then, I have especially devoted to support for heavily-indebted people through the creation of application form of bancruptcy, civil rehabilitation, specific arbitration and so on.
さらに、平成15年の司法書士法改正により、司法書士にいわゆる簡裁代理権が与えられてからは、従来の書類作成業務に加えて、いわゆる任意整理業務にも、積極的に取り組んでおります。
In addition, I am working on not only creation documents but also debt arrangement by negotiation positively after attorneyship in summary court was granted to Shiho-Shoshi lawyer by Shiho-Shoshi lawyer Act amended in 2003.
過払金返還請求について
about claims for reimbursement of excessive interest charges
昨今、いわゆる「過払金(かばらいきん)の返還請求」（時に過払い金返還請求、過払い金請求、過払い請求などとも呼ばれます）が注目を浴びています。
Recently, 'claims for reimbursement of excessive interest charges' has attracted attention.
過払金の返還請求は、最近始まった取り組みではなく、私が司法書士として本格的に債務整理業務に取り組み始めた平成9年頃においても、債務整理業務の一環として、過払い金の返還請求が行われていました。当事務所も、その当時から、過払い金請求には積極的に取り組んできたという自負があります。
It's not movement which began recently. It was already being conducted as a part of debt arrangement in around 1997 when I started to engage in debt problem in earnest. I have also conducted 'claims for reimbursement of excessive interest charges' eagerly and steadily since then.
その後、この問題に熱心に取り組む弁護士や司法書士らの地道な努力の積み重ねにより、数々の重要な判例(裁判所の判決)が出されたことなどにより、以前にも増して過払い金請求が活発に行われるようになりました。そのこと自体はたいへん素晴らしいことだと思います。
Then, some important rulings were born by Supreme Court thanks to accumulation of steady efforts by lawyers and Shiho-Shoshi lawyers working on this problem eagerly around this country. Because of that, 'claims for reimbursement of excessive interest charges' became to be done more actively than before. I think itself is wonderful.
しかし、一方で、最近、一部の弁護士や司法書士が、過払い請求をもっぱらビジネスとしてとらえ、大々的な広告等を用いてより多くの顧客を獲得し、より大きな利益を得ることに専念している現状は、正直、残念でなりません。
Meanwhile, however, it is really sad that a part of lawyers and Shiho-Shoshi lawyers are entirely thinking it businesslike and focusing into increasing of benefit through big scale of advertising.
私が司法書士になる遥か以前から、多重債務者の救済活動に献身的に取り組んでこられた先人たちからすれば、私などはひよっこであり、そんな私が意見を述べるのは、生意気なようで気が引けるのですが、それにしても、今のこの「過払いビジネス」とでも呼ぶべき状況には、どこかしら違和感を抱かざるをえません。
Compared to pioneers who have been working devotedly on saving suffering debtors since long time ago before I became a Shiho-Shoshi lawyer, I am just like a child. Therefore, I hesitate to say this opinion here. However, I can't be without feeling abnormality for current situation, namely 'Kabarai Business' or 'claims for reimbursement of excessive interest charges for only business'.
私たちが法律家の使命として受け止め、先人から受け継ぎ、共に目指してきたはずの「多重債務者の救済」という本来の目的から離れて、過払い請求だけが、利益追求に熱心な一部の弁護士や司法書士のためのビジネスとして、一人歩きしているかのようです。
It seems to be apart from the primary purpose, namely 'saving suffering debtors', which we inherited as a mission of legal experts from our predecessors and have pursued together. And it seems to be walking solely as a business for some lawyers and Shiho-Shoshi lawyers who are keen to pursue their own interests.
どこに問題があるのかを、きちんと説明するのは難しいことですが、それより何より、単純に、おかしいものはおかしいと、まずは声を出していくことが必要だと思い、ここにこのような文章を書かせていただきました。
It is difficult to explain neatly where the problem is. But I think it is important to say openly "Abnormal things are just abnormal". So I wrote these things here.
異論もあるでしょうが、少なくとも、これまで利益を二の次にして、自らの信念に基づきこの問題に一生懸命取り組んでこられた弁護士さんや司法書士の中には共感してくださる方もいると信じています。
There will be other opinions. But I believe that there will be some lawyers and Shiho-Shoshi lawyers who will sympathise to me among those who have been working on this problem disregarding their own interests, based on their beliefs.
多くの声が発せられることを、期待しています。
I am expecting that many voices will be released from a lot of people.
これから 〜松本の地で〜

当事務所は、平成20年4月、長野県 岡谷市から長野県 松本市に事務所を移転しました(結婚を機に妻が暮らす松本に引っ越してきたのがその理由であり、他に特別な意味はございません)。
My office has been relocated from Okaya City to Matsumoto City in April 2008. The reason is that I have moved to Matsumoto where my wife had lived after I married her.
これまで最も力を注いできました債務整理業務について、さらに取り組みを強化するとともに、ここ、松本市において、みなさまからの、より幅広いニーズにお答えすることができるよう、日々、精進してまいります。今後とも、どうぞよろしくお願い申し上げます。
I will work for helping suffering debtors more than before. In addition, I will do my best here to be able to correspond to your wide needs from now on. Your continued support will be greatly appreciated.
