Q		What should be noted for acquisition of status of residence (visa) for a baby born to foreign parents?
A		The baby can stay in Japan up to sixty days from the date of birth without acquiring a status of residence. However, in case where the baby is going to stay in Japan for longer than sixty days, it is necessary to proceed with acquisition of status of residence within thirty days from the date of birth.
Q		What are the procedures for marriage between a Japanese national and a foreign national in Japan?
A		To have their marriage registered in Japan, they have to submit a report of the marriage to a city office which requires the signatures of two witnesses. In submitting this report, a foreign national needs to prepare for a “certificate of legal capacity to contract marriage”. After the registration the foreign national needs to obtain a “spouse of Japanese national” visa at the Immigration Office.
Q		What visa is required in the case of marriage to a non-Japanese who has, for example, a working visa?
A		This is called a “dependent (family stay)” visa. In the case of this visa you will need to have permission from the Immigration Office to work.
Q		Can a foreign national stay in Japan after he or she gets divorce from a Japanese spouse?
A		The foreign national is supposed to have a “spouse of Japanese national” visa. After divorce he or she loses the basis of the visa. It is possible, however, to continue to stay in Japan, for example, if he or she has had a child of a Japanese national and takes custody of the child in order to raise the child him or herself. In this case he or she could change his or her visa to a “long term resident” visa.
