PROVISIONAL RELEASE FROM DETENTION IN JAPAN


A person detained under a written detention order or deportation order may apply for provisional release. His/her proxy, spouse and relatives can apply on his /her behalf. However, this is not always permitted and can be problematic unless there are specific grounds. A bail bond on his/her behalf can not be set at more than three million yen, and may be substituted by a letter of guarantee which contains the amount of the bond and a statement that it will be paid at any time.

In applying for provisional release, the necessary documents are: application for provisional release, statement for pledge, letter of guarantee, documents regarding financial status and other documents specific to the case in question. It is important to explain the grounds of which would justify the granting of provisional release.
